What a lame excuse for using (ie stealing) someones material. By this logic, no one who is famous could ever be sued.

McCain didn't "steal" Jackson Browne's material. That's a really stupid accusation. Legally, a person can use any song they want for anything if it isn't for resale or to make money profit. McCain did not need his permission. However, when a movie maker uses someone's song, they must get written permission because the movie is making money.
