A U.S. judge has dismissed Axl Rose's lawsuit against the makers of popular video game Guitar Hero.

The Guns N' Roses frontman accused Activision Blizzard bosses of acting fraudulently in 2010, alleging they had illegally used his band's music and included an image of former guitarist Slash in 2007's Guitar Hero III: Legends of Rock - despite promising not to feature any reference to the ex-bandmate or his new group, Velvet Revolver.

Rose's fraud and misrepresentation claims were thrown out last year when Los Angeles Superior Court Judge Charles Palmer ruled the statute of limitations had expired on the case, but he allowed Rose to proceed with his charge of breach of contract in January.

However, on Thursday, Palmer threw out the remainder of the 51 year old's allegations, according to local publication the San Marino Tribune.

Rose and his former guitarist have been locked in a furious war of words with each other ever since Slash quit the group in 1996.
