Jennifer Garner's alleged 'stalker' was arrested for violating his restraining order on Monday - he was found near the actress and Ben Affleck's daughter Violet's school.

Steven Burky was ordered by a judge last month to stay away from the Alias star's family for the next three years. He was also told to stay 100 yards from the actress, Affleck, Violet, the couple's nanny, housekeeper and others.

Garner claimed "Mr. Burky has been stalking and harassing me," sending "packages and letters containing delusional and paranoid thoughts and following me around the country... his obsessive and harassing behavior has escalated to the point of becoming dangerous and threatening."

However, the order hasn't deterred Burky - he was arrested on Monday after he was found near four-year-old Violet's co-operative school in Los Angeles, according to RadarOnline.com.
