James BrownJames Brown's widow Tomi Rae Hynie has won the right to be able to choose who will become the special legal guardian for her son, after the superstar's trustees tried to appoint someone themselves. Back-up singer Hynie and her son James Brown Jr. have been shut out of the soul legend's will, with his trustees claiming she wasn't legally married to Brown and that another man was the father of the young James.

The soul singer's partner wants to appoint her attorney, Stephen M. Slotchiver as the special legal guardian, so they will be allowed to have a DNA test and confirm whether Brown is the biological father.

Brown's family has previously tried to stop Hynie from entering the South Carolina home they reportedly shared before his death. However, in February she was given permission to enter and pick up some of her personal possessions.

Hynie and her son were locked out of the singer's home immediately following his death.

Hynie says, "If they could be so heartless as to lock a widow and a fatherless child out of their home and continue to give us a hard time, why would they all of a sudden take interest in representing my son and try to claim that it was in his best interest.

"If they were looking out for his best interest we wouldn't even be in this predicament."
