Britney Spears' constant partying since she filed for divorce from Kevin Federline three weeks ago could have huge repercussions on her custody battle with the wannabe rapper. Spears split from Federline last month after two years of marriage.

Both Spears, 25, and Federline, 28, are seeking sole custody of their two sons together, Sean Preston, 15 months; and three month old Jayden James, but are requesting their exes are given visitation rights.

Since the singer announced her newfound single status in New York City last month, she has been spotted partying - often pantyless - in Los Angeles, Las Vegas and Miami, Florida; nearly every night for the past three weeks.

The New York Post's Page Six column claims the Los Angeles Department of Children & Family Services - who visited Spears in April after Sean Preston was injured when he fell out of a broken highchair - is trying to set up a follow-up meeting with the singer to discuss her parenting.

A source says, "The department has been calling Britney trying to set up a meeting with her, so they can check on Sean and Jayden. The calls started after this recent bout of bizarre public behavior."

Divorce lawyer Dylan Mitchell tells Fox News the singer's wild behavior could be damaging for her divorce battle, saying, "Her behavior is potentially creating an issue that shouldn't otherwise exist. She could give Mr. Federline some leverage. If she continues like that, he could turn around and say, 'She's never home and other people are parenting the children.' My recommendation to her is that she mind her Ps and Qs. Everybody's watching - not only the news media and the paparazzi, but the judge. Now is not the time to party. Now is the time to be Super Mom."
