Writer's Viewpoint: Injustice In The Chris Brown Court Decision

Chris BrownLast week singer Chris Brown reached a plea bargain deal with the courts in Los Angeles with regards to his having beaten the crap out of his one time girlfriend, Rihanna.

Let me repeat the last part of that sentence to allow you to fully take that in, Chris Brown beat the crap out of Rihanna.

This is not hearsay, this is not some bad rumor or an urban legend; this is terrible fact.

The terms of the agreement has Brown pleading guilty to one count of assault while making criminal threats in connection to his having beaten the crap out of Rihanna. He is set to start serving five years of probation and it forces him to either spend six months in jail or the equivalent amount of time doing "labor-oriented service" - which is roughly 1,400 hours.

While taking into consideration that Brown has no prior criminal record, Judge Patricia Schegg said, "I want Mr. Brown treated as any other defendant who comes to this court."*

This same treatment across the board puts the general public at risk.

As you might guess, this is a perfect example of how the justice system and celeb reality in the United States is screwed up beyond belief. It is also a stunning moment in time that is a sadly missed opportunity for celebrities along the media to speak out and become vocal about how domestic violence and violence against women is a big no-no.

The Crime
As per the Search Warrant and Affidavit used in the investigation of the beating:

"Brown was driving a vehicle with Robyn F. (Rihanna) as the front passenger on an unknown street in Los Angeles. Robyn F. picked up Brown's cellular telephone and observed a three page text message from a woman who Brown had a previous sexual relationship with. A verbal argument ensued and Brown pulled the vehicle over on an unknown street, reached over Robyn F. with his right hand, opened the car door and attempted to force her out. Brown was unable to force Robyn F. out of the vehicle because she was wearing a seat belt. When he could not force her to exit, he took his right hand and shoved her head against the passenger window of the vehicle causing an approximate one inch raised circular contusion. Robyn F. turned to face Brown and he punched her in the left eye with his right hand. He then drove away in the vehicle and continued to punch her in the face with his right hand while steering the vehicle with his left hand. The assault caused Robyn F's. mouth to fill with blood and blood to splatter all over her clothing and the interior of the vehicle.

Brown looked at Robyn F. and stated, "I'm going to beat the shit out of you when we get home! You wait and see!" Robyn F. picked up her cellular telephone and called her personal assistant, Jennifer XXXX at (818) XXXXXXX XXXXX did not answer the telephone but while her voicemail greeting was playing, Robyn F. pretended to talk to her and stated, "I'm on my way home. Make sure the cops are there when I get there." (This statement was made while the greeting was playing and was not captured as a message). After Robyn F. faked the call, Brown looked at her and stated, "You just did the stupidest thing ever! Now I'm really going to kill you!" Brown resumed punching Robyn F. and she interlocked her fingers behind her head and brought her elbows forward to protect her face. She then bent over at the waist, placing her elbows and face near her lap in an attempt to protect her face and head from the barrage of punched being levied upon her by Brown. Brown continued to punch Robyn F. on her left arm and hand causing her to suffer a contusion on her left triceps that was approximately two inches in diameter and numerous contusions on her left hand. Robyn F. then attempted to send a text message to her other personal assistant, Melissa XXXXX Brown snatched the cellular telephone out of her hand and threw it out of the window onto and unknown street.

Brown continued driving and Robyn F. observed his cellular telephone sitting in his lap. She picked up the cellular telephone with her left hand and before she could make a call he placed her in a head lock with his right hand and continued to drive the vehicle with his left hand. Brown pulled Robyn F. close to him and bit her on her left ear. She was able to feel the vehicle swerving from right to left as Brown sped away. He stopped the vehicle in front of XXXXXXX and Robyn F. turned off the car, removed the key from the ignition and sat on it. Brown did not know what she did with the key and began punching her in the face and arms. He then placed her in a head lock positioning the front of her throat between his bicep and forearm. Brown began applying pressure to Robyn F's. left and right carotid arteries causing her to be unable to breathe and she began to lose consciousness. She reached up with her left hand and began attempting to gouge his eyes in an attempt to free herself. Brown bit her left ring and middle fingers and then released her. While Brown continued to punch her, she turned around a placed her back against the passenger door. She brought her knees to her chest, placed her feet against Brown's body and began pushing him away. Brown continued to punch her on the legs and feet causing several contusions. Robyn F. began screaming for help and Brown exited the vehicle and walked away."

All of that violence is what Brown has admitted to having done by his pleading guilty. In effect Brown is saying "Yes, I was the aggressor, I beat the crap out of her and wanted to kill her but she screamed too loud for me to finish her off."

While taking Chris Brown and Rihanna out of the equation ask yourself this question: Would I want a grown man out on the street after he punched, beat and choked my daughter or sister or mother while saying he wanted to kill her?

Should that be my loved one who was beaten, despite my tree hugging pacifist ways I would most likely want to do grave harm to the man responsible and would be very hard pressed to not go after him and seek revenge; yet the justice system says, "Oh no, all this violence on his part is fine because this is his first time getting caught doing such things and he admitted doing it. Go home now, we solved the case and handed out justice."

Shame on Chris Brown
Maybe Chris Brown was brought up with the thought that beating a woman is acceptable, or maybe he just ignored the simple life lesson that hitting a woman is not acceptable in life; in any event, he should have known better.

The bottom line on Chris Brown is that this beating doesn't give him street cred, it only shows that he is a young man with an obvious anger problem who is incapable of dealing with the reality of life in a calm and collected adult manner. Oh and lets me not forget this, it also shows that Brown is capable of beating up a 100lb woman.

Shame on Rihanna
While Rihanna only signed up to be an entertainer and not to be the face of violence against women, she should have come out with a stronger stance on the mere fact that mothers and fathers should be teaching their sons that they should never raise their hand in an act of violence towards a woman.

Rihanna missed the perfect opportunity to bring the simple subject matter up on mainstream media that "violence against others is bad and that violence against women should never happen in our society." She could have been the rallying point for people as a whole, to be the face against domestic violence and violence against women in a way that could have helped many, many people, and instead she chose to turn a blind eye, look away and pretend as if all of this never happened.

This could be because she might be stubbornly and foolishly stupid in love with Chris Brown or perhaps it is a career move because too many influential people might lose money should the truth actually be spoken out of her mouth publically.

In any event, Rihanna has missed the boat to be for battered women what Rosa Parks was to people living in segregation. Rihanna, if you're reading this, remember this, one person can change the world if they step up to the plate.

Shame on the Justice System
Shame on the Justice System in the United States for allowing people who do and act as Chris Brown did to be allowed to walk away scot free. Sure, these violent criminals have to go see a probation officer several times a year for several years and they have to do community service, but they are essentially off scot free in that they are free and able to go about and continue to do as they please in spite of having shown by past actions that they are extremely violent when words and words alone would have prevailed.

In effect, they are free and able to perpetrate more violence at their own will.

Dealing with violent criminals in this manner shows acceptance for their type of archaic criminal ways and thus shows a slight glimpse from the halls of justice that violence is accepted; leaving it to suggest that society as a whole might be better off in dealing without the "long arm of the law" when it comes to ensuring that justice is served when it comes to punishment for past crimes.

The bottom line is that people who break common laws in egregious manners along the same line as Chris Brown should do time behind bars.

Final Verdict
With Chris Brown being subjected to five years of probation, I think it's fairly safe to say that unless he has matured leaps and bounds during the last couple of months, Brown will likely break the rules of his probation at some point in time and will end up behind bars for a significant portion of this life having learned nothing from his past mistakes, but at least behind he'll be bars where there are no 100lb pound women for him to beat.
