Deryck Whibley is on a mission to recoup his birth name - the singer took ex-wife Avril Lavigne's name when they wed in 2006 and now he wants rid of it.

The Sum 41 frontman decided to legally change his name to Deryck Jason Lavigne Whibley when he tied the knot with the pop singer, but now, three years after their divorce, Whibley is finally getting around to changing his name.

He recently filed a petition in a Los Angeles County Court to drop 'Lavigne' and go back to his birth name, according to TMZ.com.

Meanwhile, Lavigne has moved past their broken marriage at a quicker pace - she exchanged vows with Nickelback singer Chad Kroeger in July (13).
